The provisions of Article 500 of Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code prescribe that if an application for a single authorisation is submitted, that will require the advance approval of the customs authorities concerned.
In case of temporary importation, the application has to be submitted to the customs authority of the place of first use without infringement of the second subparagraph of Article 580, paragraph (1).
In other cases, the application has to be submitted to the customs authority of the location where the applicant's main accounting records are kept in order to promote the auditing of procedures or where at least a part of the storage, processing or temporary exportation activities stipulated in the authorisation take place.
In cases wherein it is not possible to determine to competent customs authority in accordance with the above provisions, the applicant shall submit the application to the customs authority of the country where its main accounting records facilitating audits are located.
The appointed customs authorities forward the application and the draft authorisation to the other customs authorities involved, which shall verify receipt within 15 days. The other customs authorities involved shall communicate any objections within 30 days of receipt of the draft authorisation. If objections are communicated within that deadline and no agreement is reached, the application is to be rejected to the extent warranted by the objections.
The customs authorities may issue the authorisation if no objections to the draft authorisation are received within 30 days. A copy of the final authorisation is sent to all the customs authorities concerned.
In accordance with Article 32, paragraph (1) of Decree no. 15/2004 (IV.5.) of the Minister of Finance on the detailed rules of the application of the Community Customs Code, during the issue of single authorisations the issuing customs authority must forward the application and the draft authorisation immediately to the Central Hungarian Regional Headquarters of the Customs and Finance Guard for the purpose of coordination with other Member States. The authorisation may only be issued with the approval of the customs authorities concerned.
Copies of authorisations issued in accordance with the above procedure shall be forwarded directly by the Central Hungarian Regional Headquarters of the Customs and Finance Guard to the customs authorities of other Member States involved.
According to legislative provisions, the Central Hungarian Regional Headquarters of the Customs and Finance Guard liaises with the other Member States of the European Union with regard to single authorisations with national competence in the Republic of Hungary.
